By accessing or using the services and/or products of The Mind Raised and Danielle Shoemaker, including any collaborators, contractors, representatives, or affiliated entities acting on their behalf, you agree to the terms contained in this document.

If you do not agree to these Terms and Conditions, you may not use the services.

You must be at least 18 years of age to use the services of The Mind Raised and Danielle Shoemaker.

If you are under the age of 18, coaching services may only be provided with the written consent of a parent or legal guardian. A parent or legal guardian may be required to participate in or supervise sessions as determined appropriate by The Mind Raised and Danielle Shoemaker.

Nature of the Coaching Relationship

Coaching provided by The Mind Raised and Danielle Shoemaker is an educational and developmental service.

Coaching is not psychological counseling, mental health treatment, medical care, legal advice, financial advising, estate planning, or any other licensed professional service.

Danielle Shoemaker is not a financial advisor, broker, or dealer. No content provided during coaching sessions constitutes financial advice or a recommendation for any specific investment or financial decision.

Coaching does not replace therapy, medical care, legal counsel, or financial advisory services. You are responsible for seeking licensed professional support where appropriate.

You acknowledge that you are solely responsible for your decisions, actions, and results arising from coaching services.

Assumption of Risk and Independent Responsibility

By engaging with The Mind Raised and Danielle Shoemaker in any capacity, including but not limited to coaching sessions, programs, workshops, events, written materials, recordings, digital content, website access, or informal communications, you do so voluntarily and at your own risk.

You accept full responsibility for how you interpret, apply, implement, or disregard any information, guidance, or perspective provided.

You are solely responsible for your personal, relational, financial, business, emotional, and physical decisions and outcomes.

The Mind Raised and Danielle Shoemaker do not control, direct, or assume responsibility for your choices or their consequences.

No Guarantees

The Mind Raised and Danielle Shoemaker make no guarantees regarding specific outcomes or results from participation in services, programs, workshops, or events.

Limitation of Liability

To the fullest extent permitted by law, The Mind Raised and Danielle Shoemaker, including affiliated entities, collaborators, contractors, representatives, employees, and agents, shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to:

Coaching services
Participation in programs or events
Website use
Digital content
Communications
Reliance upon information provided

This limitation applies regardless of whether liability is alleged under contract, negligence, tort, strict liability, or any other legal theory.

Your sole remedy for dissatisfaction with services or content is to discontinue participation.

Limitation of Liability Cap

To the fullest extent permitted by law, the total liability of The Mind Raised and Danielle Shoemaker for any claim arising from services or content shall not exceed the total amount paid by you for the specific service giving rise to the claim.

You agree that this limitation is reasonable and forms an essential basis of this agreement.

Release and Indemnification

You agree to indemnify, defend, and hold harmless The Mind Raised and Danielle Shoemaker, along with affiliated entities, collaborators, contractors, officers, employees, representatives, volunteers, venues, and agents, from any and all claims, liabilities, damages, losses, costs, or expenses, including attorney fees, arising from:

Your participation in services
Your decisions and actions
Your use of digital platforms
Your reliance on provided information

You release The Mind Raised and Danielle Shoemaker from any claims arising directly or indirectly from your participation.

Intellectual Property

All materials, frameworks, written content, recordings, methodologies, and content provided by The Mind Raised and Danielle Shoemaker remain their exclusive intellectual property.

No materials may be reproduced, distributed, republished, transmitted, taught, or used for commercial purposes without prior written consent.

Public website content may be reproduced only if properly cited:

Coaching does not carry the same legal privilege as licensed therapeutic services.

Dispute Resolution and Arbitration

Any dispute arising out of or relating to services provided by The Mind Raised and Danielle Shoemaker shall first be addressed through good faith informal resolution.

If unresolved, the dispute shall be submitted to binding arbitration conducted exclusively in the State of California in accordance with the rules of the American Arbitration Association.

You waive the right to participate in any class action claim against The Mind Raised and Danielle Shoemaker.

Each party shall bear its own legal fees unless otherwise required by law.

Time Limitation on Claims

Any claim arising out of or relating to services must be brought within one year from the date of the event giving rise to the claim. Failure to do so constitutes a permanent waiver of such claim.

International Users

The Mind Raised and Danielle Shoemaker operate from the State of California, United States.

If you access services from outside the United States, you do so on your own initiative and are responsible for compliance with the laws of your jurisdiction.

All services shall be deemed performed in the State of California.

The Mind Raised and Danielle Shoemaker make no representation that services comply with the laws of jurisdictions outside the United States.

Force Majeure

The Mind Raised and Danielle Shoemaker are not liable for failure to perform services due to events beyond reasonable control, including natural disasters, illness, government restrictions, internet disruptions, platform failures, or acts of third parties.

PRIVACY POLICY

This Privacy Policy applies to information collected through the website operated by The Mind Raised and Danielle Shoemaker.

Personal information may be collected when voluntarily submitted through contact forms, registration forms, or service inquiries.

Collected information may include name, email address, phone number, and information necessary to provide services.

Personal information will not be sold. Information may be shared only with secure third-party payment processors or where required by law.

PAYMENTS, REFUNDS, AND CANCELLATIONS

Payment Structure

Coaching services are paid in advance. Monthly arrangements are billed prior to the start of each new month. Additional sessions must be paid in advance.

Accepted payment methods include Zelle, PayPal, and Venmo.

All payments must be made in United States Dollars (USD). If paying from outside the United States, you are responsible for currency conversion fees, exchange rate differences, foreign transaction fees, and banking charges.

The full agreed service fee must be received in USD. The Mind Raised and Danielle Shoemaker are not responsible for exchange rate fluctuations or third-party processing fees.

Non-Payment, Chargebacks, and Payment Enforcement

All fees are due in advance.

You agree not to initiate any chargeback, payment dispute, reversal, or claim for services rendered or fees due.

Initiating a chargeback for valid services constitutes a material breach of this agreement.

In the event of a chargeback or non-payment:

The full outstanding balance becomes immediately due.
Remaining installment balances accelerate and become immediately payable.
Services may be suspended or terminated.
You are responsible for chargeback penalties, bank fees, arbitration costs, attorney fees, and collection expenses.

Unpaid balances may accrue interest at the maximum rate permitted by law.

Payment obligations survive termination of services.

Cancellation of Ongoing Coaching Agreement

Written notice must be provided prior to the beginning of the upcoming billing month.

Payments already made are non-refundable.

Session Cancellations and Missed Sessions

Cancellation with less than 24 hours’ notice results in forfeiture of the session.

Failure to attend constitutes a completed session.

Late arrival does not extend session time.

Rescheduling is subject to availability.

Refund Policy

Payments for services rendered are non-refundable.

Prepaid monthly coaching fees are non-refundable once the billing cycle begins.

Event-specific refund policies apply where stated.

Governing Law

These Terms and Conditions are governed by the laws of the State of California.

Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

Waiver

Failure to enforce any provision does not constitute waiver.

Entire Agreement

These Terms and Conditions, together with the Privacy Policy and the Payments, Refunds, and Cancellations section, constitute the entire agreement between you and The Mind Raised and Danielle Shoemaker.

They supersede all prior discussions or agreements.

No modification is valid unless in writing and signed by both parties.

Electronic Acceptance

Electronic acceptance, including digital signature, checkbox acknowledgment, or payment submission, constitutes binding agreement.
